US Court Orders Freedom of Abrego Garcia from ICE Custody

Legal scene

A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling allegations, he was held in federal custody.

In her order, the judge pointed out that the government does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal challenge center on disputed assertions. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.

Terms of Freedom

The judge, who was overseeing his petition to deportation in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.

This ruling represents a significant turn in a complex legal case featuring allegations of mistaken imprisonment and disputed criminal affiliations.
